Terms of Service
These Terms of Service ("Terms") govern your use of the FoundRank.ai Portal (the "Portal"), a business software platform provided by FoundRank.ai for capturing leads, managing customers, and (where enabled) sending quotes, invoices, and collecting payments. By creating an account or using the Portal, you agree to these Terms.
Who can use the Portal
The Portal is provided to businesses we onboard directly. Each business account has an owner, who can invite additional staff users. You are responsible for keeping your login credentials secure and for activity on your account.
Your responsibilities
- You will only send text messages and calls through the Portal to people who have agreed to be contacted by your business.
- You will not use the Portal to send unlawful, deceptive, or unsolicited messages.
- You are responsible for the accuracy of the business information, pricing, and documents you create in the Portal.
- If invoicing is enabled on your account, you are responsible for your own tax and licensing obligations related to the work you bill for.
Billing
Portal access is billed month to month. There is no long-term contract requirement for standard pricing. You can cancel at any time; access continues through the end of the current billing period. If you dispute a charge for the Portal itself, contact us first so we can resolve it directly.
Payments your business collects from its own customers through the Portal are processed by Stripe under a separate account you control. Stripe's own terms govern those transactions, including disputes, refunds, and chargebacks.
Text messaging and phone numbers
Each business is assigned a dedicated phone number for calls and texts sent through the Portal. You must have the right to text and call the numbers you contact through this service, and to comply with applicable telemarketing and messaging laws (including TCPA-related rules in the United States). We register your messaging use with our carrier partners on your behalf as part of onboarding.
Your data
Your business's customer and lead data belongs to you. You can export it at any time, and we will provide a full export if you close your account. See ourPrivacy Policy for how we handle information collected through the Portal.
Service availability
We aim to keep the Portal available and reliable, but we do not guarantee uninterrupted service. Phone calls will continue to ring through to your business even if an automation feature is temporarily unavailable, but no computer system is guaranteed to be free of downtime or error.
Disclaimer and limitation of liability
The Portal is provided "as is." To the extent allowed by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Portal, including lost leads, lost revenue, or missed messages. Our total liability for any claim related to the Portal is limited to the amount you paid us for the Portal in the three months before the claim arose.
Termination
Either party may end this agreement at any time. We may suspend or end an account that violates these Terms, sends unlawful messages, or creates risk for other users of the platform.
Changes to these Terms
We may update these Terms as the Portal changes. We will update the effective date above and, for material changes, notify active accounts directly.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
